Shopping terms


The sale and supply of all goods available via our website (“Goods”) is governed by these terms and conditions of sale (the “Shopping Terms”) and our General Legal Notices and our Privacy Policy (which together shall be referred to as the “Agreement”). Please read these Shopping Terms carefully before purchasing products from our website. You should print a copy of these Shopping Terms for your future reference.


1. OUR DETAILS
This website is owned and operated by Walker Books Limited, 87 Vauxhall Walk, London SE11 5HJ (registered in England under company registration number 1378601 and registered under VAT number 235 3794 49) ("we", "us", “our” or “Walker Books”).


2. YOUR CONTRACT WITH US
To purchase any Goods for sale on our website, you must submit a completed order. All orders are subject to our acceptance. Your order represents an offer to purchase a product from us.
Your offer will be accepted by us when we send you a confirmation e-mail (the "Confirmation"). The Confirmation will be sent to you once we have received full payment for your order and we have begun to process your order. An additional e-mail will be sent to you once we have despatched your order.
This contract is legally binding when you have placed an order, your order has been accepted by us and we have sent you the Confirmation (the "Contract").
We will supply the Goods you have ordered in accordance with the Confirmation and the Shopping Terms in force at the date of the Confirmation. Contracts will be concluded in English. We may not keep a record of all electronic Contracts concluded via our website. You should therefore print off and keep a copy of the Confirmation as soon as you receive it.


3. DELIVERY
Goods sold by us on our website are despatched from the United Kingdom and cannot be despatched to customers ordering from Australia, New Zealand, the United States or Canada. Customers from these locations should visit our sister company websites www.candlewick.com and www.walkerbooks.com.au


4. AGE REQUIREMENT AND CHANGES TO OUR SHOPPING TERMS
You agree that any personal information you are required to provide is true, accurate, current and complete in all respects. You must notify us immediately of any changes in your personal information by contacting us at Shopping.
To be eligible to purchase Goods from our website, you must: (a) be at least 18 years old; (b) specify a valid delivery address and (c) possess a valid credit or debit card issued by a reputable bank.
If you are under 18 years old, you can only purchase Goods from our website with the help of a parent or guardian.


5. ORDERS AND QUOTES
We may correct any error on our website (e.g. the price of any item or any other details in any unconfirmed order) without any liability to you.
We reserve the right to make any changes in the specification of the Goods on the website to conform with appropriate legal requirements.


6. PRICE AND DELIVERY
The price of the Goods shall be the price set out in our Confirmation. Please note: this may be different from the price for the item quoted on this website on the date you placed your order (for example, because of an inadvertent, obvious or other pricing error (whether technical or otherwise) on our website). Please check the Confirmation carefully.
All prices are quoted in GB pounds sterling. The price of the Goods is inclusive of any applicable Value Added Tax.
We reserve the right to revise the price of any Goods on this Website without notice. We also reserve the right at our discretion to refuse to supply to you, whether you are an individual or company, for whatever reason.
The price of the Goods excludes the cost of packaging and delivery (the "Delivery Charges"). For details of our delivery methods, times and the Delivery Charges please see our Delivery Details.
Goods will be delivered to the delivery address specified in the Confirmation (the "Delivery Address") by our appointed fulfilment agents Macmillan Distribution Ltd. You are responsible for all applicable customs and import duties and/or taxes that may be levied on the Goods.
All delivery times quoted are estimated times and are subject to stock availability. Where Goods are temporarily unavailable, we will contact you and let you know when we expect the Goods ordered to come into stock. You can then let us know whether you would like to wait until the Goods come into stock or if you would like to cancel your order. If you would like to cancel your order, please quote your invoice/order reference and notify us by one of the methods specified in 9(a) below. We will then refund you the money paid for any Goods ordered.
If you do not take delivery of the Goods or give us adequate delivery instructions, we may store the Goods until actual delivery and charge you for the reasonable costs (including insurance) of storage and/or additional delivery costs.


7. PAYMENT TERMS
You may pay for your order by credit or debit card. Credit and debit card payments must be made online (via our SSL secure payment system) using either of the following accepted:

• credit cards: VISA, Mastercard, Electron, Purchasing; and

• debit cards: Maestro (previously Switch), Solo, Visa Delta.

We will charge your credit card or debit your bank account when or shortly after we acknowledge your order. All credit card payments are subject to validation checks and authorisation by the card issuer.


8. RISK AND OWNERSHIP
We retain ownership of all Goods ordered until they have been delivered to you. Ownership of and risk in all Products shall pass to you upon delivery.


9. RIGHT OF CANCELLATION AND RETURNING GOODS
Subject to the purchase of Goods from this website being for personal use only and not for resale:
(a) You may cancel any purchase (except as indicated in (d) below) for any reason within 7 working days (this does not include Saturdays, Sundays and U.K. Public Holidays) of your receipt of Goods by giving us written notice of cancellation in any of the following ways:

• by e-mail to customerservices@walker.co.uk; or

• by post or personal delivery of a letter to Walker Books Customer Services, c/o Macmillan Distribution Ltd, Brunel Road, Houndmills, Basingstoke RG21 6XS; or

• by fax to Walker Books Customer Services, c/o Macmillan Distribution Ltd at +44 01256 812558.

You must quote your Invoice Number and state which Goods you are returning when you send your notice of cancellation.

(b) You will be responsible for and will pay the cost of returning the Goods to us. The Goods will be returned at your risk and should be sent to the following address together with a copy of the invoice that came with your Goods:

Returns Department, Macmillan Distribution Ltd., Lye Industrial Estate Pontardulais Swansea SA4 1QD, U.K.

Goods must be returned in the condition they were in when delivered to you accompanied by all accessories and associated documentation. Please note:

• if you fail to take reasonable care of the Goods we reserve the right not to accept their return and your payment will not be refunded; and

• the Goods are your responsibility until they reach us and we cannot be held responsible for Goods lost or damaged in transit, we recommend you pack them carefully, obtain proof of despatch and arrange appropriate insurance.

(c) Provided Goods are returned to us, in the manner set out in 9(b) above, within 30 days of receipt of your written notice of cancellation, we will refund any monies paid to us in respect of the cancelled order as soon as possible but in any event within such 30 day period. The refund will be for the price of the Goods returned as stated on your invoice, excluding all Delivery Charges.

(d) No right of cancellation exists where the Goods that you wish to return are (i) audio, video, or computer software products that have been removed from the sealed package in which they were delivered; (ii) downloaded material; and (ii) goods that have been personalised or specially ordered. This does not affect your right to return purchases under Clause 10 below.
 

10. INCORRECT/DAMAGED GOODS
Without affecting your right of cancellation under Clause 9 above, if the Goods delivered to you do not include all of the Goods that you ordered or include incorrect or damaged Goods, you may return such Goods to us but you must inform us in writing (via any of the methods set out in 9.(a) above) within a reasonable time from the date of delivery. All such returns must be made in their original condition within a reasonable time of delivery together with a brief explanation of the fault or damage.
Upon receipt of the Goods in question, we will examine the Goods to check whether they are faulty or damaged. We may, if we think appropriate, credit you with an appropriate refund.
This does not affect your right to cancel your purchase under Clause 9 above.
We can only accept the return of opened Goods if they are faulty or damaged.
If the reason for the return is the result of our error or if the product was damaged before it reached you, we will also refund the Delivery Charges.

This does not in any way affect any of your statutory rights.
 

11. LIABILITY
Nothing in these Shopping Terms shall exclude or limit our liability for:

• fraud or for death or personal injury arising out of our, our agents’ or sub-contractors’ negligence;

• fraudulent misrepresentation; or

• any other liability to the extent that we cannot exclude or limit as a matter of law.

We will not be liable for any delay or failure to supply the Goods where this is due to circumstances beyond our reasonable control. We shall also not be liable in respect of any defect in the Goods arising from fair wear and tear or neglect (such as books left in a damp place).
 

12. WITHDRAWAL AND USE OF PRODUCTS
We may withdraw any Goods shown on our website prior to sending you a Confirmation without prior notice, or liability, to you.
 

13. GENERAL
Should any term of these Shopping Terms be found to be unenforceable, it shall, so far as it is unenforceable, be deemed deleted and the remaining Shopping Terms shall continue to apply.
These Shopping Terms shall be governed by English law. Any dispute arising from these Shopping Terms shall be subject to the exclusive jurisdiction of the English Courts.
These Shopping Terms take precedence as your invoice may contain Macmillan Distribution Ltd’s terms and conditions which are not applicable to website sites.

14. COMPLAINTS
In the unlikely event that you are dissatisfied with any of our Goods, please contact us by any of the following methods, specifying the nature of the problem:

• by fax to Customer Services, Walker Books Ltd at +44 (0)20-7587 1123.

We will investigate and respond to you regarding any queries you may have as soon as possible.
